Terms of Service

These are the terms you are agreeing to when you buy a website from us. We have tried to write them so that a busy salon owner can read them in ten minutes and know exactly what they are getting, what it costs, and how to leave.

If anything here is unclear, email hello@dalu.ca and ask. We would much rather answer a question now than have a disagreement later.

01Who we are

Dalu Solutions is a web and AI agency based in Calgary, Alberta, Canada. In these terms, “we”, “us” and “Dalu” mean Dalu Solutions, and “you” means the business buying from us.

02Who these terms cover

We sell to businesses, for business use. If you are buying a website for your salon, shop, clinic or trade, these terms apply to you. We do not sell to consumers for personal use, and these terms are written on that basis.

We do two different kinds of work, and the rules differ:

  • Website subscriptions — a website we design, host and maintain for a monthly fee. Sections 3 to 16 below are about this.
  • Custom projects — bespoke web and AI work quoted individually. Section 17 is about this.

By paying us, or by using a website we host for you, you agree to these terms. If someone accepts them on behalf of a business, they are confirming they are allowed to do that.

03Previews we build before you ask

Most of our subscription customers first hear from us because we have already built them a website. We want to be plain about how that works, because it is unusual.

We look for newly licensed Calgary businesses that have no website, or one that is holding them back, and we build a complete preview of what their site could be. The owner then gets a message from a real person — on Instagram or Facebook, sent by hand — with a link to it. Nothing about that process is automated, and we send one follow-up at most, five to seven days later, if there is no reply.

A preview is built only from information that is already public:

  • The business’s own social media profile
  • Its existing website, if it has one
  • Municipal business licence data published by the City of Calgary

That content is used in that business’s own preview and nowhere else. Every preview:

  • Lives at a temporary address such as yourname.dalu.ca
  • Is blocked from search engines, so it will not appear in search results
  • Expires automatically 30 days after it is built
  • Carries a “remove this” link that needs no account, works immediately, and asks you for no reason

A preview is not a contract, an invoice or an obligation. You owe us nothing for it, and you never will. If you want it gone, use the removal link on the preview itself — we record that the request came from your business so we do not contact you again.

If you think your preview uses something that is not yours to publish, or that we have got something wrong about your business, email us at hello@dalu.ca and we will take it down.

04Website previews

When you request a preview, Dalu Solutions builds it from your business’s public information and photos, such as your Instagram, Google listing and current website. If you choose to claim it, the price is $89/month + GST with a 12-month minimum, plus the domain at its actual price.

05Plans and prices

Each business is offered one of two plans, fixed when their preview is built. All prices are in Canadian dollars and 5% GST is added on top.

Plan A
$499 to start, then $49 per month. Month to month, cancel any time.
Plan B
$0 to start, then $89 per month, with a 12-month minimum term. After 12 months it continues month to month.
Domain name
Charged separately at cost. See section 8.

Your first payment covers the setup fee, the first month, the domain if you buy one through us, and GST. It is taken at checkout, and the monthly fee then recurs on the same day each month.

We may change our prices, but not yours mid-stream: any change to your monthly fee takes effect no sooner than 30 days after we email you about it, and never before the end of a minimum term you are in.

06What your subscription includes

  1. 01A website designed for your business, with its own colours, type and photographs.
  2. 02Hosting and the security certificate.
  3. 03A login that lets you edit your own text, photos, services, prices and opening hours.
  4. 04A mobile-first, fast-loading build.
  5. 05Your existing booking link — Fresha, Vagaro, Square, Booksy — on every booking button.
  6. 06Search engine basics: page titles, descriptions and structured business details.
  7. 07Your business details published in a form AI assistants can read accurately.
  8. 08An optional connection to your own Google Analytics account, off unless you turn it on.
  9. 09If you already have a website, your current content moved across.
  10. 10Support by email or message, from Calgary.

We aim to answer support messages within one business day. That is a commitment we take seriously, not a guaranteed response time you can hold us to in law.

07What costs extra

These are not in the monthly fee. We will quote them before doing any of them, and you are never billed for work you did not agree to:

  • New pages or sections beyond the template
  • Changes to colours, fonts, layout or section order after launch
  • Third-party integrations and embedded widgets
  • Copywriting or photo sourcing after launch

Editing your own words, prices, hours and photographs through your login is always included and always free.

08Domain names

A domain name is priced and charged separately from your subscription, at the real registration price at the moment you buy it. We do not mark it up. We do not offer domains that cost more than $200 CAD.

You own it

You are the registrant — the legal owner — of any domain bought through us. Domains we buy for you are currently held inside our registrar account with you named as registrant. You can ask us to transfer a domain to your own registrar account at any time, for any reason, and we will start that transfer promptly and without charge.

Renewal

Because the domain sits in our account, the registrar charges us for renewal and we re-bill you once a year at the actual cost. We will email you before that charge. If you would rather not be billed by us for renewals, transfer the domain to your own registrar and pay them directly.

If you already have a domain

You can connect a domain you already own, at no charge. If that domain currently has a website on it, that website stops being visible once the domain points at us. We will say this to you before you choose, and we are saying it here too. Make your own copy of anything on the old site before you connect the domain.

09Who owns what

Yours
Your business content: your text, your logo, your photographs, your prices, and your domain name. You keep all of it, during and after the subscription.
Ours
The template, the design system and the code that runs the platform. While you are subscribed you have a licence to use it for your business. You are not buying the code, and the licence ends when the subscription does.

By publishing content through us you give us permission to host, display and adapt it for the purpose of running your website — and for no other purpose. We do not use your photographs or text for anyone else’s site.

We may show your finished website in our portfolio and in outreach examples. If you would rather we did not, tell us and we will not.

10Your side of the deal

You are responsible for what goes on your website. In particular, you confirm that:

  • You have the right to use the text, logos and photographs you publish, including any photographs of clients.
  • Your prices, services, hours and licensing details are accurate and kept up to date.
  • You will not publish anything illegal, misleading, or in breach of somebody else’s rights.
  • You will keep your login credentials to yourself, and tell us if you think someone else has them.

Your booking buttons point at your booking provider — Fresha, Vagaro, Square, Booksy or similar. Those are your accounts with those companies, governed by their terms, and we have no control over whether they work or stay available.

If your website is being used for something unlawful, or in a way that puts our platform or other customers at risk, we may suspend it. We will tell you why, and we will give you a chance to put it right where the situation allows for one.

11Billing

Payments are processed by Stripe Payments Canada. Your card details go to Stripe and are never seen, handled or stored by us. Stripe’s terms and privacy policy apply to that part of the transaction.

All prices are in Canadian dollars. GST of 5% is added to every invoice, and our GST registration number is 748362738 RT0001.

Your subscription renews automatically each month until it is cancelled. Invoices are emailed to you. Plan A customers can manage or cancel their subscription themselves through the billing portal; Plan B customers inside the minimum term need to contact us, for the reason set out in the next section.

12Cancelling

Plan A, and Plan B after 12 months

Cancel whenever you like. Your website stays live until the end of the period you have paid for, and then goes offline. There is no cancellation fee and no notice period beyond the current month.

Plan B inside the 12-month minimum

Plan B has no setup fee because the cost of building the site is carried inside the monthly fee over twelve months. If you cancel before the twelve months are up, the remaining monthly payments become due. That is the agreed price of leaving early, not a penalty: it recovers the setup cost you did not pay at the start.

To cancel inside the minimum term, contact us at hello@dalu.ca and we will set out the balance in writing before anything is charged. We may reduce or waive that balance at our discretion — if your circumstances have changed, tell us and ask.

Your domain

Cancelling does not affect your domain. It stays yours — we transfer it to your registrar on request, or leave it to run out at the end of the registration you have paid for.

Your content afterwards

We email you when a subscription is cancelled. Your content and photographs are deleted 90 days after cancellation. Export or save anything you want to keep before then, because after that we cannot get it back for you.

13Refunds

  • Before your site is live: if you change your mind before we put your website live, we refund the setup fee in full.
  • Once your site is live: the setup fee is not refundable. The work it pays for has been done.
  • Monthly fees: not refundable for the billing period you are in. Your site stays live for the rest of it.
  • Domain names: not refundable. The registration is paid to the registrar the moment it is bought, and it stays yours either way.

None of this stops us doing the fair thing if we have got something badly wrong. If you believe you are owed a refund, write to hello@dalu.ca and say why.

14If a payment fails

This part is automatic, and there are no surprise charges in it:

  1. 01A payment fails. Your card issuer and Stripe retry it, and we email you.
  2. 02If the balance is still unpaid 30 days after the first failed payment, your website is suspended and visitors see a “website suspended” page instead.
  3. 03Paying the outstanding balance reactivates your website automatically.

A suspended website is not a deleted one. If the balance remains unpaid after suspension, we may cancel the subscription. We will email you before we do, and it is that cancellation — not the suspension — that starts the 90-day deletion described in section 11.

15Availability, backups and honest limits

We host on Vercel and store data with Supabase, and we work to keep your website up. We do not promise a specific uptime figure, and we are not going to invent one.

We do not currently run database backups or point-in-time recovery. The platform runs on a free database tier while the business is being proven, which means that if the database were lost, your site content could be lost with it. Keep your own copies of photographs and text that matter to you. We will say so here when this changes.

Websites need maintenance, and we may update the platform, the template and the underlying components. We try to make changes that improve your site rather than disturb it, and we will tell you in advance about anything that visibly changes how your site looks or works.

16Services we depend on

Running your website means relying on other companies. We choose them carefully, but we do not control them and cannot be responsible for their outages, their price changes or their decisions:

17Custom projects

Alongside the subscription, we build custom websites, web apps and AI integrations, quoted individually. Those engagements are governed by the written proposal or quote we agree with you — scope, milestones, price and timeline — and these terms fill in anything that proposal does not cover.

Two things are worth stating plainly, because they differ from the subscription:

  • Ownership: for custom project work, the deliverables are yours once you have paid for them in full. We keep ownership of our pre-existing tools, libraries and components, and license them to you as part of the deliverable. Third-party components stay under their own licences.
  • Payment: custom work is normally invoiced with a deposit up front and the balance on delivery, with the exact schedule set out in the proposal. Invoices are due within 14 days unless the proposal says otherwise.

A subscription website and a custom project are different products. The sections above about previews, plans, minimum terms, refunds and suspension apply to the subscription, not to custom work.

18Liability

We provide our services with reasonable skill and care. Beyond that, and to the extent the law allows, they are provided as they are, without other warranties.

We are not liable for lost profits, lost bookings, lost revenue, lost data or indirect losses. Where we are liable, our total liability to you for everything arising out of our agreement is limited to the amount you paid us in the twelve months before the claim.

You agree to cover us for claims brought by other people because of content you published through your website — for example a photograph you did not have the right to use.

Nothing here limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.

19Changes to these terms

We may update these terms. If a change materially affects you, we will email you at least 30 days before it takes effect, and you are free to cancel before it does. Minor corrections — a typo, a clearer sentence, a new service provider in the list above — take effect when published.

The date at the top of this page is the date of the current version, and it is always the version that applies.

20Law and disputes

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply in it. Disputes go to the courts of Alberta, sitting in Calgary.

Before that, though: write to us. Almost everything is fixable by a person reading your email and replying properly, and that is how we would prefer to settle things.
